What part does deception of one kind or another play in Twelfth Night?

Deception is present in Twelfth Night on a number of levels. To examine the role of deception in Twelfth Night in relation to the plot, we must consider what may have occurred if in fact there was no deception in the piece. Deception sets the whole story in motion, and is pivotal in creating the irony and comedy that abounds in Twelfth Night. It is through deceit and deception that the topsy-turvy web of comedy and confusion that entangles the characters of Twelfth Night is spun. The deception exhibited in the play can be divided into two groups. Firstly, let us consider cases of self-deception. Orsino is a classic sufferer, and continually pines away for his darling Olivia. The self absorbed Orsino believes himself to be in love with the Countess Olivia; however, it would appear that Orsino is more in love with the notion of being in love than anything else. In his opening lines he talks of his love, but it is not until seventeen lines later that he first mentions Olivia. He does not talk to Olivia, and is content to mope around his house in self-involved sorrow while he sends courtiers to woo her on his behalf. Ironically, Olivia is in a similar situation. She uses the unfortunate excuse of her brother's demise to hide herself away from the world, and shows no interest in relating to the other Illyrians. If these two characters were free of their self-deceit, and able to see themselves as they truly are, a tremendous impact would be had on the play. Perhaps Olivia would have returned Orsino's apparent love, after all he is of very noble birth. In this scenario Viola and Sebastian would be cut out of the story entirely, and the original trickery and chaos would not come about. Alternatively, Orsino may have realised the truth about his emotions and stopped his pursuit of Olivia. Cesario would not be sent to her, and Olivia would not fall in love with ‘him'. Furthermore, Sebastian and Olivia's final union would also be impossible, and Cesario would remain bound by ‘his' disguise. Olivia's steward, Malvolio, struggles to see his real self. He is of the opinion that he is in some way superior to others of his social class and deserves to be elevated to the nobility because of his supremacy. He sees himself as surrounded by ‘idle, shallow things', not of his ‘element ‘ and this feeds his unexpected ambition to the point where he is able to be fooled by Sir Toby and Maria's trickery. He is deceived completely, and Sir Toby remarks ‘. . . thou hast put him in such a dream, that when the image of it leaves him, he must run mad.' If Malvolio was not so deceived, he would not have this belief of superiority, nor would his holding of this belief be exploited. He would find the letter's message unbelievable and escape the suffering caused by his original trust in its words. His strong ambitions would remain a secret, and the sense of pity and respect we gain for Malvolio through his struggle to be deemed sane would also be non-existent. The comedy of the puritan's trials would also be lost. Sir Andrew's self-deception provides nothing but comedy. The deluded clumsy simpleton thinks he is sophisticated, noble, and a marriage prospect for Olivia. Had Sir Andrew known his chances truthfully, he would have ended his pursuit of Olivia's love. Sir Andrew's absence would result in a loss of a number of humorous debacles; however the major events of the story would be largely unaffected. The other kind of deception in the play is the deception of others. Viola is undoubtedly the most deceptive of the characters, and her deception plays the greatest role in the play. Her original desire to be disguised as a man facilitates the formation of the dreaded love triangle and the resulting complexities that make up the story of Twelfth Night. Viola's decision to conceal her true gender is the basis and foundation for the entire plot. She makes a conscious decision to hide her true self, saying: Conceal me what I am, and be my aid For such disguise as haply shall become The form of my intent. When talking with Olivia, Viola even states that she is concealing herself: Viola: †¦you do think you are not what you are. Olivia: If I think so, I think the same of you. Viola: Then think you right: I am not what I am. Was it not for Viola's deceptive disguise, she would not have become a member of Orsino's court. She would not have been sent to Olivia, nor would the mislead Olivia fall in love with Cesario, and later Sebastian. It was Olivia's love for Cesario that saved her from becoming a recluse, and this would have been her fate were it not for Cesario's arrival. Cesario would remain unknown to Orsino, and Orsino and Viola's marriage would not occur. The Duke would almost certainly have continued to wallow in his sorrows as he languished over Olivia. Viola soon becomes anxious at the massive effects of her deception: Disguise, I see thou art a wickedness Wherein the pregnant enemy does much. The major events concerning the main characters would not take place, if Viola had not deceitfully donned the disguise of Cesario. Her deceit has drastic consequences, and huge meaning for all. Even Sir Andrew would have been saved from his embarrassing duel, it Viola was not disguised. Viola's deception provides the extra dimension of dramatic irony that is present throughout the piece. The troubles created by her deception in regard to gender, and mismatched love provide many ironically comedic moments. Olivia falls head over heels in love with none other than a woman in disguise, who is in turn in love with a man, who ironically believes her to also be a man. Each character says or thinks a number of things that are ironically false and often humorous, while the audience has the luxury of seeing past the deception and realising how wrong the characters are about one another. Sir Toby, Fabian and Maria are the conspirators behind Malvolio's downfall, who is the unsuspecting victim of Maria's deceitful letter. Later Feste delivers the cruellest blow when he disguises himself as Sir Topas, the curate. Here Malvolio endures his greatest suffering as his sanity is questioned and his limits tested. Without their scheme to get square with Malvolio, we would not see him suffer or discover his other side as discussed earlier. It is only through Maria and Sir Toby's deception, that Malvolio's respectable, pitiable and admirable qualities are revealed. Sir Toby and Fabian are also behind Sir Andrew's deception. Sir Toby's false friendship and advice leads only to his enjoyment and Sir Andrew's misery. He is manipulated incredibly by Sir Toby, at all times for his personal benefit. Toward the end Sir Toby shows his true feelings for Sir Andrew calling him ‘An asshead, and a coxcomb, and a knave†¦' The resulting comedy of his suit to Olivia and his duel with Cesario, would not occur were it not for Sir Toby's deception. Antonio would also be relieved of his confusion, as he would not step in to save Viola whom he mistook for Sebastian. Near the end, Sebastian realises there is something in the extraordinary situation ‘That is deceivable'. Olivia bade Malvolio ‘return' Orsino's ring to Cesario, in the hope that he would return to her. This was fraudulent trickery on Olivia's behalf in order to see her new love again. Later she apologises for her deceptive ‘cunning ‘ but it is through this deception that the love triangle between Orsino, Olivia and Viola is strengthened. Deception facilitates the formation of Twelfth Night's intricate plot. Shakespeare uses deception on a number of levels. He alludes to the deception in the play right from the beginning, in the title. Historically Twelfth Night is the last night of twelve days of celebration following Christmas, in which social order is upturned and anything and everything goes. The subtitle, ‘Or What you will', fits well with the attitude of Twelfth Night's festivities when people could do whatever and be whoever they liked. Not only is deception essential in the construction of the plot, but it is also present so that Shakespeare can relate to us the outcomes of those who practice deception and those who are deceived. There does not seem to be a concrete system with which a character's rewards or punishment can be determined in respect to their deception. Viola, Sir Toby and Maria are some of the chief deceivers, and yet they are rewarded with wedded bliss. These characters are also able to see past much of the other character's deception. Olivia and Orsino suffer from self-deception, and nonetheless receive the same reward. Malvolio and Sir Andrew see themselves even less truly, and can find no happiness. Feste is arguably the least deceived of the Illyrians, but for this he receives no consolation. Perhaps Shakespeare is trying to show that those involved with deception, are taking a risk. Whether you are being deceived or deceiving others, you can never control, or be sure of your outcome. Shakespeare also uses deception in relation to the concept of fate. Despite the immense deception of the play, Shakespeare ensures the right people still end up together; and although deception affects their journey, their destination remains unchanged. The celebrations of Twelfth Night must come to an end, as does the play, and the happiness of some of its characters. Feste's melancholy final song does nothing to assure us of even the handful of happy characters' continued happiness. Feste's song tells a story of growing up and growing old, recounting a story of the discovery of the unkindness and harshness life. Shakespeare's ending for Malvolio and Feste, who are at opposite ends of the spectrum of deception, serve as reminders to the uncertainty of life. Both the comic plot and the romantic plot are constructed in deception. The confusion, trickery, comedy and chaos of Twelfth Night is present only because of the characters' deception of themselves and one another. Deception makes Twelfth Night what it is. It is the cause of the story, and without it Twelfth Night would be a very straight-forward, linear bore without any twists or turns. It is through deception that Shakespeare shows us the triumph of fate and the uncertainty of life, and the play gives an insight into what awaits those who gamble with deception and false judgement. Deception plays a huge part in Twelfth Night and is essential in making it the topsy-turvy, ironic, chaotic comedy that it is.

Phuket tourism Essay

This report will discuss how the rapid growth and mismanagement of the Hospitality, Tourism and Events Industry has impacted the island of Phuket, Thailand. The Tourism Industry is a major source of revenue for the island and therefore has a significant impact. The Tourism Industry has only been developing on Phuket since the 1970s, and the increased employment opportunities and income have resulted in much better living conditions for residents in this short period of time. However there are multiple problems caused by local and Thai government’s mismanagement of the industry. The sharp decline in tourist arrivals after the 2004 tsunami demonstrated the need for a wider target market in order to sustain the local economy. A major segment with the potential to bring considerable revenue to Phuket is MICE (Meetings, Incentives, Conferences and Events), which is an area of rapid growth in South East Asia. However the local government has failed thus far to develop a world class conference centre on the island. This failure to plan is also affecting the environment in Phuket, as the island does not have the capacity to dispose of the waste produced by the increased population: particularly during peak tourist season. This is just one of many problems that the government and community in Phuket must resolve in order to develop an economically and environmentally sustainable Tourism Industry. 1.0 Introduction This report will discuss the impact of the Hospitality, Tourism and Events Industry on Phuket, in Thailand. It will first briefly explain the fundamental characteristics of the HTE Industry. It will then talk about some of the many costs for Phuket caused by the ineffective management by the government of the rapidly developing HTE industry. This failure to plan has led to an unsustainable economy and an unsustainable environment which negatively affects the residents of Phuket. It will discuss how Phuket’s lack of diversity in the HTE Industry hinders potential growth in the economy. However not all of the impact on Phuket is bad. The rapidly developing Tourism Industry makes a very large contribution to the health of the local economy. It has elevated the standard of living on the island by supplying the residents with wider employment opportunities. The challenge is to find solutions to the problems faced by Phuket which satisfy the  stakeholders with different priorities: residents, businesses, development and environmental departments. Its government needs to enable its various stakeholders to collaborate in order to resolve the social, economical and environmental issues caused by the rapidly expanding HTE Industry. This needs to happen in order to develop Phuket into a sustainable tourism destination. 2.0 Fundamental Characteristics of the HTE Industry The HTE Industry consists of three segments: Hospitality, Tourism and Events. The three segments are classified as separate industries, yet they are not always easily defined as separate because many elements of each are overlapping (William Blue MGT102 Study Guide, 2013). A definition of hospitality is â€Å"The friendly and generous reception and entertainment of guests, visitors, or strangers† (Bieringa, 2012). In the HTE industry a guest is a customer, and the host is the businesses who offer services for a fee. A host can also be a place, and Phuket the city performs as a host to many tourists as a popular tourism destination. The hospitality industry consists of a wide range of businesses who provide services such as accommodation, food and beverages (William Blue MGT102 Study Guide, 2013). Na Sakohakorn (2011) explains that â€Å"Tourism involves all activities which are conducted away from home†. Therefore a business is part of the tourism industry if it conducts business with customers who are travelling outside of their home territory. Events are an integrative effort of various services with the end result of an ‘experience’ (William Blue MGT102 Study Guide, 2013). All three co-exist in a mutually beneficial relationship in which the different segments work together to meet the varying needs of their guests. 3.0 Development of HTE Industry in Phuket Phuket is the largest island in Thailand, which has been called the ‘Pearl of the Andaman’ by the Government and local tourism operators in a bid to market it as an oasis of paradise floating in the Andaman Sea (Kontogeorgopoulos 2005). It is Thailand’s second largest international gateway by air, with nearly 20 million tourist arrivals in the year 2012 (Tourism Authority of Thailand, n.d). It was a popular trading port for tin from the 16th century, until the last tin mine closed in 1992 due to a worldwide drop in tin prices (Asia News Monitor, 2009). In the 1970s the  Tourism Authority of Thailand commissioned firms to come up with plans for the development of Phuket (Lauzon, 2009.). This development resulted in heavy investments in the local tourism industry from foreigners and mainland Thais, leading to increased employment opportunities and resultantly a strong reliance of the local economy upon the sustainability of the tourism industry. This reliance has been increased overtime with the shift from traditional occupations such a tin mining, rubber tapping and fishing to jobs within the tourism industry (Kontogeorgopoulos 2005). The impact of the HTE industry here is significant due to the unusually large effects it has on the lives of local people. 4.0 Impact of HTE Industry on the Local Economy The HTE Industry is a vital element in the growth and sustenance of the local economy. This is because 38.5% of Gross Provincial Product comes from hotels and restaurants in Phuket (Ichinosawa, 2006). About 80% of locals work within the HTE Industry, with only around 20% remaining in traditional occupations. Because tourism has become such an integrated part of the economy, even traditional occupations such as fishing and manufacturing also indirectly rely on the industry for income. Tourism has many benefits to Phuket, such as increasing revenue intake, increasing employment and aiding social development by stemming the migration of youth to the mainland (Sakolnakorn, 2011). However the government has damaged opportunities to develop a sustainable plan for tourism with constant political infighting (Asia News Monitor 2009). Sustainable development is defined in the 1987 Brutland report (William Blue MGT102 Study Guide, 2013) as â€Å"Development that meets the needs of the present without compromising the ability of future generations to meet their own needs.† ` 5.0 2004 Tsunami’s Impact on the HTE industry in Phuket The catastrophic Tsunami of 2004 served to highlight the vulnerabilities within Phuket’s economy. This Tsunami was the biggest the Indian Ocean has ever seen with a devastating 155,000+ fatalities in the 11 countries it hit (Do Something, n.d). The Tsunami left a secondary impact of a stagnated regional economy in its wake. As Kasperson (2004) says, â€Å"Unfamiliar or distant places may easily fall play to distorted or stereotypical  perceptions.† Tourists stopped coming after the Tsunami, and there is no insurance against stigma. The tourism agencies selling the majority of packages to Phuket were located in foreign countries therefore local businesses could not develop good supply chain relationships with them to ensure sales continued. Phuket’s marketing strategies revolved solely around its ‘Pearl of the Andaman’ image as a paradise of sun and beaches. The Tsunami tainted this image by increasing the perception of risk for tourists visiting its famous beaches. Sales in the beginning of 2005 dropped to only 10-30% of normal rates (Ichinosawa 2006). Phuket paid the price for relying upon a small segment of a potentially diverse HTE industry. 6.0 Events as a Potential Major Source of Revenue A segment of the HTE industry with vast untapped potential for Phuket is the Meetings, Incentives, Conferences and Exhibitions, or MICE, segment. MICE events are one of the fastest growing segments in the industry and particularly in the South East Asia region. According to a study done by IHG in 2012, 50% of delegates coming to South East Asia for MICE events come from outside the region. However Phuket handicaps itself in this sector as despite decades of talks and studies it still lacks a world class conference centre (Fein, 2012). There was an attempt to build 2.6 billion BAHT centre in 2011; however the project is still in limbo as the environmental impact assessment was rejected. This is an example of the constant struggle between government departments for environmental planning and tourism resulting in a lack of efficient city planning. A world class conference centre would contribute to the local economy by diversifying the market and drawing in high spending MICE delegates (Asia News Monitor, 2010). The failure to build a conference centre demonstrates the continued failure of the Phuket government to build a sustainable economy. 7.0 Impact of HTE Development on the Environment The rapid growth combined with ineffective management has resulted in many environmental issues in Phuket. An article in the National Geographic Traveller rated Phuket’s environmental status as 46/100 and categorized it as ‘in serious trouble’. These problems spawn from a lack of planning, combined with irresponsible environmental behaviour due to lack of  discipline in Thai culture, and increasing materialism and consumerism (Boonchai, Beeton, Srichai). The rising population and urbanisation have drastically increased the use of natural resources, with approximately 75% of the environmental impact being caused by the consumption of non-durable goods, water and energy (Ruiz-Molina 2010). An example of the problems caused by over-population is the piling up of solid waste on the island. Phuket’s incinerator only has the capacity for 250 tonnes of waste per day, while the island produces 300-350 tonnes per day. This means that the excess waste is piling up at the rate of 50-100 tonnes every day. Phuket also can only provide 30,000 cubic meters of water, yet the demand is 40,000 per day (Lauzon, 2009). The disputes between development and environmental protection sectors of the government hold back progress in finding solutions to these issues. These government departments fail to seek the input of the many varied stakeholders on Phuket who could offer vast insight into potential solutions: the business owners and local people (Boonchai, Beeton, Srichai). Once again these unresolved issues highlight the inability of the local government in facilitating a satisfactory compromise to achieve long term sustainable development in Phuket. 8.0 Impact on Local Residents The development of the HTE industry in Phuket has brought many increased challenges into the local people’s lives; however the benefits outweigh the costs for most residents. One particularly dark segment of the industry which affects local women and children is Sex Tourism. Prostitution began due to a lack of employment opportunities for uneducated women during the Vietnam War (Ehrfurcht, n.d). It has been illegal since 1960, but the law is rarely enforced due to the government’s reliance upon it to maintain the economy (Morison, 2008). A wide survey of tourists revealed that 17% thought that the sex industry was motivation to come back to Thailand as it is easy to find (Rittichainuwat 2008). It is so easy to find because it is practiced widely in bars and brothels, and like in other segments of the Tourism Industry locals are increasingly being replaced by foreign women (Hanenberg 1998). Another area where the Thai people are being replaced is the labouring industry. It is increasingly expensive to employ residents due to the high cost of living on Phuket, which means more labourers are being hired from the Union of Myanmar (Sakalnakorn, 2011). The increasing  migration of people from the Union of Myanmar, also known as Burma, is causing a perceived loss of culture and increased crime rate in the local community. Despite all of the negative aspects introduced to Phuket by the HTE industry development, quality of life has been improved for residents. 9.0 What the Future Holds for Phuket Phuket has rebounded from the economic downturn following the Tsunami. The average hotel occupancy rate was a very healthy 75% for the year 2012 (Chinmaneevong, 2012). This rebound has been spawned by new direct flights from China and Eastern Europe, combined with lower costs from competition with the local cheap airlines. The Tourism Authority of Thailand’s marketing targets for 2014 and beyond are health and wellness tourism, golfers, honeymooners and weddings, and ecotourism. It is targeting the first three areas due to the high spending customer demographics in each segment. Kontogeorgopoulos (2005) says that the â€Å"Desire to spend leisure time in natural settings is a key factor behind the recent rapid growth of ecotourism†. The challenge for tourism operators is Phuket is to give the Ecotourists the perception that they are still on a paradise island, despite the mass tourism and close proximity to urban areas. This is achieved partly through â€Å"communicative staging† (Kontogeorgopoulos 2005) where the landscape near resorts is designed to give the appearance of a natural environment. Guests to Phuket can also go for day trips to Phi Phi and other nearby islands which remain untouched by urbanisation to experience the sense of exploring a natural island environment (Lauzon, 2009). All stakeholders in the Phuket community (locals, businesses and government alike) wish for Phuket to be regarded as a ‘Green City’ in the future (Boonchai, Beeton, Srichai). This can only be achieved by engaging all members of the local community to form a comprehensive and sustainable development plan for Phuket (Xing, 2011). 10.0 Conclusion This report discussed the effects of the Hospitality, Tourism and Events Industry on the island of Phuket. The Industry’s rapid development has resulted in economic benefits, but has had some negative side effects upon society and the environment. The problems have been caused by the Thai and local government’s lack of compromise, lack of planning and failure to  enforce laws. Phuket seems to have not learnt from the 2004 Tsunami that economic reliance upon a small segment of the HTE industry is not a good long term plan in the changeable modern world. The new era of mass tourism which is hitting Phuket now, combined with the level of opportunity currently growing within the MICE segment in South East Asia, is an opportunity to develop more diversity in order to maintain its economy. It is vital that sustainability of the Tourism Industry is achieved as the local economy has become dependent upon it. Protecting the environmental is of equal importance as the Tourism Industry and people’s livelihoods depend on an attractive and natural-seeming environment in order to keep the guests arriving. Hopefully the many stakeholders in Phuket can find solutions so the island can develop as a Green City with a stable economy. CapitalimSocialism Essay Research Paper There are many

Capitalim-Socialism Essay, Research Paper There are many different economic systems that reside in someway throughout the universe today like capitalist economy and socialism. Here in the United States, we live in a assorted economic system? ? one in which private endeavor and governmental engagement coexist? . Presently Americans? lives are centered on the person, harmonizing to Adam Smith. At the same clip, the authorities controls many facets of American? s lives. In order to make up ones mind which economic system I sided with, I realized I must understand what each system stands for. Socialism is the belief that wealth should be distributed every bit among people. Although this sounds like a great manner for all people to be affluent, I have a job with their non being a wages for those who work hard and have an outstanding imaginativeness. Socialism rejects private ownership and competition for net income. I think these are things that persons need to do themselves more productive in the concern universe today. I believe that competition for net income helps an person to endeavor for greater personal accomplishments. On the other manus, I like the fact that socialism emphasizes cooperation and societal duty. Capitalism is merely the antonym: it is centered more around the people and their achievements. It is based on private ownership, where as socialism dismisses it. Capitalism allows people to work to bring forth their ain economic value. I believe that people should be rewarded for their difficult work, and socialism doesn? t allow much room to make so. Capitalism, or the free endeavor system, lets persons set up and run their ain concerns. It was noted that the? United States depends on the energy and thrust of 1000s of single capitalists? . After this spot of research, I would hold to hold with both Paul Johnson and Adam Smith. Johnson said capitalist economy provides the best economic construction and Smith was the 1 to state that in doing everyone wealthy, the state will go affluent excessively. I wholly agree that each person is entitled to his or her ain free belongings and free will, which is granted by capitalist economy. I wish we could populate in a capitalist economic system with a socialist medical specialty system. I don? T think it? s carnival that merely because one individual has more money than another, they have a better opportunity to have medical aid. The idea of a kid acquiring turned off from a surgery that could salvage their life because they are hapless interruptions my bosom. So, if there was a manner to unite the medical ways in socialism with the profitable ways of capitalist economy I think there could be a really strong economic system.

Leadership Term Paper Example | Topics and Well Written Essays - 1000 words - 1

Leadership - Term Paper Example The traits required for becoming an effective leader is to firstly value the team members, developing a vision for the organization, sticking to the golden rule which is to treat the employees/team members in a respectable way. Other traits of effective leaders are to admit the mistakes if they occur and try to rectify them immediately. If employees need to be criticized, they should be done privately and not in front of the other employees. All plans should be according to the aims and objectives of the organization and leaders should work upon promoting a healthy and competitive environment of the firm. Leadership Style & Skills and Importance of attending Talks & Relationships The type of leadership skill required for a CEO of a consumer technology corporation is the democratic style of leadership and the transformational style of leadership. The final decision in this leadership style is taken by the leader but the employees or team members are allowed to give in their opinions a nd suggestions for the decisions that are to be taken by the organization. The team members’ views and suggestions are pondered upon by the leader and the best possible option is decided by the leader. The team members are actively involved in the projects and decisions and are well aware of the progress of the organization. In this type of leadership style, the level of job satisfaction among employees is high and so is the productivity level of the firm. Being a consumer technology corporation, changes in the field of technology are taking place at a dynamic mode and hence via a democratic leadership style the organization has the opportunity to be on the right track and would also be meeting the expectations of the consumers accordingly. Through the democratic leadership styles by leaders, the skills of the team members or employees are also developed. The leader also gets a chance to discuss various issues with team members and hence these talk sessions allows the confide nce and morale level of the employees to be boosted. Hence it is extremely important for the leader to follow and communicate the vision of the firm in an explicit manner to the employees or team members of the organization. A leader sets the tone for the organization by developing certain sets of values and principles for the firm. The vision and mission statement reflects upon the tone of the organization and employees therefore know the direction of how they should perform their work and also know about the rules and regulations that are to be followed in the organization. By following the mission and vision, the leader is able to optimize their potential capabilities on leading the organization (Northouse, 2012). Leader Having

UK housing bubble is demand related with prices falling slightly in 2008 due to low demands (Economic Outlook, 2013, p.6). Identification of economy bubble is easy contrary to beliefs of many economists. Signs of housing bubble were evident in London over two years ago. Over a year since then, the prices have continued to rise making the more unaffordable to people. This poses many dangers to those living or willing to live in London city, as the cost of living will also is unbearable. The house price bubble probably affects all the sectors in London’s economy. Localization of the effect of house price bubble has base in London alone now and other areas may experience their own bubbles. Rise in houses prices does not currently discriminate location of the area. It takes place all over the city. At first, one may think investors have taken even the poor regions of the city due to high prices. Percentage house prices increases in Brent and Lambeth were almost similar to those in Hammersmith & Fulham and Westminster. The rate of price rice in London is above that in any place in Britain and the rise is consistent since 2003 while all other factors changed slightly. House price rise estimation is at 18 percent. Although the rate of increase has not reached tat of 2007, its overall prices remain high than those in 2007. Building society has confirmed that t this percentages are greater than they had been before. The impact of high house prices affects the economy, which in turn cause low living standards. High debts numbers has macroeconomic impact that may cause recession, which has great effects. The house prices in comparison to employees’ wages bring out the effect clear. In the past decade, salaries payable to any

Biohacking in the mass market Essay Example | Topics and Well Written Essays - 3000 words

Biohacking in the mass market - Essay Example This hacking ethic has resurfaced again in garages, kitchens and closets all throughout the world. In this modern world, the practice of soldering circuit boards and programming in FORTRAN has been replaced with splicing DNA and cloning bacteria. These practices in particular are referred to, what is called in today’s world, as bio-hacking. Bio-hackers involved with this practice, manipulate the building blocks of life thereby advancing knowledge and creating new life forms with novel purposes. As has been witnessed in the past few decades, computer hacker movement sparked a revolution in the field of computer science and information technology. The revolution increased the pace at which technology had progressed thereby permanently changing the societal landscape. Similarly, it is expected that the bio-hacker movement or rather the practice of bio-hacking will have a parallel effect on the technologies solely based on biology. These changes will not only bring about a massive development in the field of science but will also fundamentally alter human experience itself. The pioneers of this regime shift would be today’s bio-hackers. ... This is primarily because with proper information more and more people will gain expertise about this product and eventually will be able to make an informed decision regarding their usage and utility (Alba and Hutchinson, 1987). The underlying idea of this business is to distribute and install the body modifications using an agreement with a chain of tattoo studios. The product that will be offered to customers is magnetic implant which is another form of body piercing. According to Brownlie and Saren (1991, p. 35), â€Å"the marketing concept defines basic benchmarks against which marketing practice, i.e. what organizations can be judged.† In order to make a successful business venture, all those benchmarks need to be met. The result of these actions can be easily measured by the market share and profitability that the business will achieve, once it has fully implemented all the marketing strategies. One of the primary drawbacks related to this business approach is that it i s a completely unexplored area and henceforth it is going to be comparatively difficult for the owner to assess the risk associated with every operation. In addition to that, the pricing of the product will be a cause of concern as there is no relative market to compare the prices in order to set it accordingly. There is a potential failure associated with the pricing of the product. If the product is priced too high, then it will trigger a negative signal within the target market and as a result, the consumers might choose to refrain from availing products from this entity. Furthermore, another cause of failure that can be attributed to this business approach is the potential side

Multi-faceted role of the teacher Essay Example | Topics and Well Written Essays - 3000 words

Multi-faceted role of the teacher - Essay Example Educators design curriculum to help them set learning paths for their students. This noble task has been attempted repeatedly and in various contexts in the hopes of improving curriculum. It can be said that educators always work towards a curriculum that empowers the learner. It would greatly benefit him and future generations to come. Curriculum comprises the whole school programme. It covers a broad spectrum - from how the physical environment is designed, which skills are targeted to be developed in the children, which concepts and activities are appropriate for the age group, what are the routines to be included and how one transitions from one activity to another. Marsh (2004) defines curriculum as a variety of learning experiences where students gain general skills and obtain knowledge in different learning sites. This definition concentrates more on learning and learning skills rather than teaching. It also values the practical skills gained from other learning sites other than from school alone. Grundy (1987) in his definition describes curriculum as ‘A programme of activities (by teachers and pupils) designed so that pupils will attain so far as possible certain educational and other schooling ends or objectives’ (Grundy, 1987, p.11). It is evident that any curriculum definition one way or another puts emphasis on the learning process, gained knowledge and skills, subject content and students’ comprehensive learning experience. In designing an appropriate course curriculum, an essential process needs to be considered including which curriculum model is most suitable for the needs of the learner. The process of learning is as important as the content learned (Newby 2005). Constructivist theory is gaining more attention, recognition and acceptance in many educational institutions. Its curriculum premises on the belief that learners â€Å"construct† their own

Art and Photography - Essay Example Her photographs are a visual testament to her creations which are not subject to the viewers interpretation. One does not have to prefer the work of Laurie Simmons to realize that she is conveying a message. Indeed, "Walking, Talking Lying" exposes her comments on what is happening in society today. Her manipulations are sarcastic and are a haunting reminder of where the world is headed. Her photographs tell the story of interplay between people and objects. For example, in "Walking Talking Lying" there is a black and white photograph of a woman's lower body with a gun as its' head (Simmons 1-160). The gun is a small revolver - one which can be easily be handled by a woman of any size and body is covered by a thin black slip. Even the harshest of critics cannot say that this piece is a mere photograph. It is a statement that is offered by Ms. Simmons which compels the looker to reflect on the state of women today, based upon her recollections of Oftentimes, a viewer may consider artwork to bring pleasurable feelings and that is not necessarily one that emanates from the depictions of Ms. Simmons. I regard art to be a form of communication. It is not an intellectual article, or frothy novella. It is not limited to Monet's pond scenes and Chaucer's prose. Art is something that compels reflection. The photographs of Ms.

Accounting-IFRS Essay Example | Topics and Well Written Essays - 1000 words

Accounting-IFRS - Essay Example This difference between the IFRS and the GAAP is the core of other differences between the two standards. A major difference between the two standards is the way revenue is recognized. The GAAP has more extensive guidelines on revenue recognition compared to the IFRS. The IFRS has two standards of dealing with revenue recognition while the GAAP provides several concepts as well as detailed rules to deal with revenue recognition in different industries. The IFRS requires revenue to be recognized when it is likely that the benefits associated with a transaction can be traced to the entity and quantified reliably. In contrasts, the GAAP provides criterion for determinable or fixed pricing in revenue recognition. In this case revenue cannot be recognized until the amount of the revenue is ascertained. This implies that under the IFRS revenue that is not of a set amount is recognized earlier as compared to the GAAP (Erchinger, and Winfried 124). Another point of difference between the two standards is in relation to financial assets. The IFRS only provides two standards to deal with financial assets while the GAAP has extensive guidelines that apply in various industries. While the IFRS classifies assets into various categories, the GAAP classifies financial assets into pronouncements. The GAAP looks into the legal form of the entity while classifying financial assets while the IFRS considers the nature of the instrument. Financial asset classification is important as this affects income statements and the entities equity. Different classification of financial assets by the two standards can significantly affect the amount in the entity‘s financial statements. There is also a major difference in the manner the two standards treat intangible assets. While the GAAP does not allow for capitalization of internally incurred costs related to development, the IFRS allows for this capitalization when certain criteria are met. In relation to asset impairment, the IFRS

Social and Personal Related Factors Influencing Teenage Pregnancy Essay Example for Free

Social and Personal Related Factors Influencing Teenage Pregnancy Essay Introduction Teenage pregnancy or adolescent pregnancy is the early conception of female whose age ranges from 13 to 19. Just recently, adolescent has become an important issue in health in great number of countries, both developed and developing. However, pregnancy in adolescence is not an unusual phenomenon as it keeps on rising every now and then. There are lots of speculations about which factors triggers pregnancy the most. Some of these factors were deemed to be poverty, socioeconomic factors, educational attainment etc. Actually, a family with history of teenage birth is considered as one of the factor that influences teenage pregnancy. Teen female with family history of teenage births are significantly more likely to experience teenage pregnancy (East, et.al 2007). Childhood history of sexual abuse has also been taking in place as a factor of having early pregnancy. This factor increases the risk of teen women for subsequent adolescent pregnancy and that addressing conditions associated with childhood sexual abuse might impact the overall pregnancy rate (Noll, et.al. 2009). Somehow, even non expected factors such as childhood bullying were deemed to contribute for teen to have early pregnancy. Childhood bullying tends to have negative effect on the childhood of teen females. In fact, both bullies and victims had high risk of becoming teenage mothers regardless of the family-related risk factors. Reports of bullying and victimization from the girls themselves, their parents and their teacher were associated with becoming teenage mother independently of each other. Therefore, there is a predictive association between being a bully in childhood and becoming a mother in adolescence and it may be useful to target bullies for teenage pregnancy prevention (Lehti, et.al 2010). Conclusively, there are lots of factors which are deemed to influence teenage pregnancy and it is still a mystery that which factors we should consider above them all thus awareness could be given to those who will need it mostly. The aim of the study is to determine whether which of the social-related or personal-related factors greatly influences teenage pregnancy. Thus, when the study have determined and relay the results this could serve as a basis or guidelines for women to avoid early pregnancy. While for the parents of female teenager this will enable them to know of what aspect should they consider to avoid this teen pregnancy from happening and even for nurses, to conduct health teaching and public awareness that teenage pregnancy can always be prevented just as long as the action plan includes proven data and has the real factors that might lead teenagers to this unwanted and early pregnancy. Significance of the Study The study is deemed to be relevant in nursing profession and for the community in establishing a link between rendering care for the community both in Public and Private setting. The result aims to determine or to discover which among the following factors influences the teen women to be pregnant the most. The study is believed to benefit the following.

Is Astrology A Pseudoscience?

Is Astrology A Pseudoscience? In order to ascertain whether or not something is a pseudoscience or fake science, one must first know what pseudoscience is. Here, I am going to illustrate the many different points which distinguished philosophers such as Michael Radner, Densie Radner and Paul Thagard have made on what is a pseudoscience to evaluate astrology, which is the study of how the heavenly bodies such as the planets and the constellations affect us and instead offer that Astrology is simply not science, much like religion or poetry is not like science. Already, if one were to look up Astrology in a collection of online dictionaries, there will be definitions such as a pseudoscience claiming divination by the positions of the planets and sun and moon however wether the writer of such definitions knows why or how astrology is a pseudoscience remains a mystery, perhaps they, like the 192 scientists and 19 noble prize winners who signed the statement against astrology Bart Bok, Paul Kurtz and Lawrence Jerome, support it being a pseudoscience because it goes against their instincts and rational thinking which is really not enough evidence for anything to be classified as a pseudoscience. For example the three most important issues raised by the statement which was signed by these scientists proclaimed that: Astrology originated as part of a magical world view. However so did chemistry (it arose from alchemy) and doctors use to believe that the body was made of humours and today even honour the Hippocratic origins of medicine by still making the Hippocratic Oath. The planets are too distant for there to be any physical foundation for astrology. While the planets are distant, there are certainly ways distant objects can influence our lives. For example if the sun were to explode, that would certainly make an impact upon our daily lives. People believe in astrology out of longing for comfort. While some people believe astrology out of longing for comfort, so they too, believe in religion or the existence of gravity every time they jump so that one does not fear that whenever one jumps one may drift off into space and thus this does not define astrology as a pseudoscience. If there is anything to speak for astrology as a science it would be that astrology uses the scientific method. The scientific method as developed by many scientists like Einstein as well as well known philosophers such as Kuhn, Popper, Feyerabend and Lakatos consists of observation, hypothesis, experimentation and verification. As astrology focuses on observing the location of the sun and the planets as well as their effect on people, which is the basis of astrological charts and readings it clearly satisfies the first condition. When an astrologist makes a chart of someones birth and makes reading upon that of how their life will be like, that is a hypothesis. The subject living his or her life is the experiment and at the end of their life they can verify whether or not the reading came true. Verification is strongly focused on the results not falsifying the hypothesis but even for lack of that, does an experiment falsifying the hypothesis make it unscientific? High school chemist ry experiments were still science experiments even if the results were not what we expected to them to be. Thus we can say, yes astronomy does follow the scientific method, although through experiments such as one conducted by a French psychologist Michel Gauquelin, where he sent the horoscope of a criminal to roughly 150 people as their horoscope and 94% believed it fit them1, we can see that actual verification may be something difficult to achieve when it comes to astrology, most likely because of how vague and all encompassing the readings prove to be. To some of us, the fact that astrology doesnt make sense in that there are no physical forces in play from planets millions of miles away is enough to declare astrology a pseudoscience. However, as is pointed out by various astrologists, Einsteins theory of curved space seemed absurd until it was proven true and many similarly absurd proposals are still considered science. Philosophers through the ages have also debated (although mostly just agreed) that astronomy is a pseudoscience. One of the most famous demarcations of science is Karl Poppers theory of falsifiability; however astrology cant be classified be a pseudoscience using this. Thagard brought up the points very well in his article Why is astrology a pseudoscience that Popper himself said that no observation ever guarantees falsification because the hypotheses can always be changed and thus falsification can only be a category if a better theory is invented2. Thus although no hypotheses made by astrologists can convince them that astrology doesnt work, astrology can technically be replaced by a modern day Ptolemy- maybe the composition of the planets affect us instead of the gods that rule them or something and thus is falsifiable. Speaking of the gods however, therein lays one of the greatest weak points that show astrology as something that isnt very scientific. Science is the same through all languages, hydrogen is still an atom made of a proton no matter whether its name is in English or Chinese. The planets, named after Greek gods are not the same across languages yet names of things appear to be of the utmost importance to astrologers. Venus who is named after the goddess of love deals with the emotional side of things while Mars is the god of war and thus if youre born under the house of Mars you will be evil,  warlike and contentious because of [your] choleric nature3. Even more worrisome is that the 12 zodiac constellations arose from the Babylonians around the same time the Chinese and Hindus had 28 constellations. Furthermore, the names of the constellations appear to also affect people who are born when theyre in the sky, for example people that are born when the sun is in the quadrant of the sky where Aries the Ram is are supposed be aggressive and assertive like the animal itself. This leads us to the various marks of pseudoscience that D. and M. Radner have set out of which being able to satisfy any one of these conditions is considered to be unscientific4. Anachronistic Thinking Their first demarcation refers to reverting to age old theories that once held fruition in the past. Astrology is a fairly age old theory that was the origins of astronomy whereby in the past astrologers were also astronomers and observed the movements of the planets and the stars. As the correlations of the position of the planets and stars appear to have been passed down from the beginning of astrology from observations made on how the planets affect people from thousands of years B.C., this does seem to apply. Furthermore the moon and the sun are still considered planets in astrology and one would think if Astrology was kept up to date, that someone would have removed them from the equation. In comparison, in order to see the effects of drugs on people we have textbooks which would have new editions every few years to show new findings and remove findings that have been proven false. The main textbook of astrology is still Ptolemys  Tetrabiblos  which was written in 200 AD. In Thagards article Why astrology is a pseudoscience Thagard also proclaims that astrology is uncritical and unprogressive because it never tries to solve unsolved problems like what happens in natural disasters where people with many difference charts, star signs, houses all die in the same way2. Looking for mysteries While astrology does not appear to be deal with mysteries of human experience such as UFOs, there are many mysteries associated with something that is supposed to be scientific. If one were to look up the chemical reaction between hydrogen and oxygen, one would find the same answer from any knowledgeable chemist. If one were to ask 10 different astrologers for their horoscope, one would find many different readings which opens the questions as to which reading is the correct reading. For example a collaboration of studies show that in a group of 559 astrologers when 5- 30 of them are asked to agree or disagree with a given reading of 762 different birth charts, most of them cant even agree that each chart means the same thing. Appeals to Myths Astrology does not actually appeal to myths, instead a quick browse of the Journal of Astrology website would show that it does appeal to old readings that have come true6, namely those made to estimate political outcomes and lives and deaths. However, absent on the site are indication of the numbers or examples of death predictions that have not come true. The grab-bag approach to evidence Astrology does appear to favour large amounts of evidence in that astrologers refer to how many readings in the past have come true (disregarding those that havent) and this method is helped along through the popularity of daily horoscopes in our newspapers whereby every horoscope can most likely correspond to every person. In fact the collaboration of 54 studies that have tested astrologers by giving them charts and telling them to match their owners showed that the average rate of success was the same as if you or I randomly matched them. Irrefutable Hypotheses While astrology is not irrefutable there are many ways and loopholes which allow it to never reach that point. For example, if a reading is wrong a) the person taking the reading could be deluding themselves and really are what the reading says b) the astrologer could have read it wrong c) The person lied about their location of birth and time d) this particular astrologer made it up but the next may make a true reading. The list of possible causes for already vague readings to be wrong that doesnt disprove astrology in any way can go on and on as there is no possible control to be tested (i.e. someone who isnt under the influence of the stars). It is because of the ease at which these wrong hypothesises can be explained and are explained that causes Popper to claim that astrology is irrational and Kuhn to claim it to be astrologys downfall when it comes to being a science as it means their results will never lead to any sort of further research or progression2,7. Argument from spurious similarity A mark of pseudoscience is that the pseudoscientific has a base of principles which are already part of legitimate science. Astrology definitely has a basis in astronomy however there was once a time where astronomy was based on astrology and the star charts and movements of planets used in astrology would coincide with those used in astronomy. Explanation by scenario Astrology uses its own laws to explain different readings and conclusions. For example Uranus is likely a cooling planet due to its modern rulership of Saturns traditional sign Aquarius . These rules and laws most likely originated from original scientific observations of the ecliptic rotations of the planets when it was believed that everything revolved around the earth (seeing as the moon and the sun were classified as planets) and then further built upon with various theories from the Gods they are named after, for example Jupiter is the chief of the gods and thus can rule over other gods. Research of Exegesis Astrologers are selective in their use of scientific research, they do not as many pseudo scientists do, which is to simply take science as statements instead of looking for the reasoning and facts beneath but they do not take into account all scientific research either. For example Michel Gauquelin in an experiment found that there is a greater than chance association of people who are born under Saturns rising or zenith to be scientists and that example may be used by astrologers as a scientific experiment that supports astrology. However, experiments looking at horoscopes of twins born in the same location and at the same time with drastically different futures lay hidden beneath the carpet. Refusal to revise in light of criticism This mark of pseudoscience is something that relates greatly to astrology. Because the Earth is not perfectly spherical, the axis of the earth tilts back and forth in a 26000 year cycles and due to this, the quadrants the constellations occupy in the sky no longer befit with that of when astrology charts were created thousands of years ago. This is called precession and is a problem that astrologers are yet to answer especially since they continue to make predictions as if the constellations still occupy the same part of the sky they use to. Furthermore with the invention of modern day hospitals and caesarean births that causes the time of birth to be different by many hours and sometimes preserves a baby that would have otherwise died, there presents lots of problems with something that is calculated from ones birth time. Apart from fore filling many of the marks of pseudoscience D. and M. Radner have listed, astrology is a topic that has been criticized by many philosophers. Diesing pointed out that astrologers do not collaborate with other scientists like many of the sciences do8, Feyerabend compared it to medieval astronomy whereby it had interesting ideas but they werent developed through any kind of proper research in order to understand how it worked9. Grey in a summarization points out that astrology has a lack of controls and has ill defined concepts that cant be refined and are hard to test10. Most of these philosophers seem to agree that while science is continuously being challenged by anomalies, new theories and results which allow it to progress; astronomy tends to reject these occurrences and thus becomes stagnant. Criticism for astrology does not only stop here even as far back as 44 BC there existed documented criticism against astrology and example of this would be the critique written by Marcus Tullius Cicero who was a Roman statesman. One of his best points was that people do not expect childrens personality or behaviours to be affected by the weather conditions in which they are born and these conditions obviously have by far more effects on a person than dim lights which shine in the sky. He continues that even if children born in the month of December were in some way to be similar how would one know it is not because they were born in cold weather as opposed to the sun rising while a constellation is in the sky11?   This was a very valid point at the time when it was written and thinking along the same lines creates a variety of problems which would be difficult for an astrologist to answer such as why doesnt the amount and gender of people in the immediate vicinity of the baby being born affect the babys personality instead of the stars. Conclusion While it is clear that astrology is a pseudoscience as described by many famous philosophers like Thagard, Kuhn and Feyerabend, I propose that astronomy ought to be classified as something that is not science as opposed to fake science. Because astrology was the origins of astronomy and thus is somewhat intimately connected with science and yet so obviously not scientific, there has been much debate as to its status. However, I would like to point out that it is the scientists who are concerned with the accuracy and effectiveness of the tests conducted on astrology and that, astrologists, while being dismissive of all negative results and findings are really more concerned with the satisfaction of those that seek their wisdom. Rather, astronomy is really more like a religion where people have faith in things that cannot be seen and is rather successful at making people feel connected to society. It provides a way for us to describe ourselves and realize qualities in ourselves and gen erally there are fairly little negative impacts in believing in something like astrology (apart from maybe an unhappy boy who you dont want to date because hes Aquarius). Even better, while it affords the same degree of actual use as a placebo, tests for the accuracy of astrology show as much or as little result as tests for the effectiveness of prayers and instead of having to pay weekly to fund the Church, all you have to do is get your chart made once and from then on, are able to blame the stars for your failings. As Leahey and Leahey said, astrology provides a means for pursuit of happiness and is in a way like a cheap method of psychology where you can discover yourself while letting the stars take the blame for any bad attributes you have and yet be comforted at the same time since there is no God to judge you at the end.

Maintaining the Audiences Interest in Talking Heads :: Talking Heads Alan Bennet Essays

Maintaining the Audience's Interest in Talking Heads One character talking to a camera for half an hour, Do you call that drama? How does Alan Bennet try to maintain the audience’s interest in his Talking Heads? In A Lady of Letters, Patricia Routledge plays the part of Irene Ruddock, who is a very lonely woman that has an obsession with writing letters to everyone to complain about the smallest of things. She lives by herself, and has done since her mother died. A Lady of Letters is a drama because it includes different amounts of lighting at certain points of the video. Routledge also acts when she is speaking to the camera, for example she gets very upset at some points e.g. when she talks about when the police told her the little boy over the road had died of leukaemia. She also expresses herself well by her actions. At first Irene seems like a very highly classed woman, very respectable and knows what is wrong and right. She also appears to be a very respectable lady. We know this because in the video, it shows her having her tea and biscuits with a napkin. However, throughout the video, we see some changes to Irene; we see that she might not be as respectable as we first thought. One of these reasons is because when she goes to the doctors, she says â€Å"I said I was getting upset, like I did before†¦Ã¢â‚¬ This indicates that she may have been ill because of certain happenings which were probably to do with the letters which she writes. Shortly after this, she lets us know about when the vicar came around, talking to her about god. She then tells us about how she is an Atheist. We do not expect this because you would have thought someone as respectable as Irene would believe in God and go to church every Sunday morning. â€Å"They don’t expect you to be an atheist when you’re a miss†¦Ã¢â‚¬ This shows that because she told the Vicar that she was an atheist, he did not know what to say, because he like us expected her to believe in God and go to church like every other respectable lady like her. Next we hear about her visit from the Police, which is where we find out what she really is like. At first, the male police man talks about the different types of letters which she had wrote in the past, and then we find out that she has been told to keep the peace by the courts. At this point, we finally realise that she isn’t that

Apple and the Personal Computer Revolution :: Technology Computers Steve Jobs

Apple and the Personal Computer Revolution Let’s take a trip back in time and review the evolution of a computer company. It’s not IBM or Microsoft. This company is Apple Computers, Incorporated. In the year 1976, before most people even thought about buying a computer for their homes. Back then the computer community was only a few nerds building simple computers from hobby kits. When Steve Wozniak and Steve Jobs sold a van and two programmable calculators for thirteen hundred dollars and started Apple Computers, Inc., in Jobs garage, the reach for success seemed far. But these two young business men, Wozniak 26 years old and Jobs 21 years old, had a vision. â€Å"Computers aren’t for nerds anymore,† they announced. â€Å"Computers are going to be the bicycle of the mind. Low cost computers for everyone.† From the first day on the founders of Apple kept their vision intact, and they spoke it at every turn. They only hired people into the company that had the same visions as they did. In early 1976 Wozniak and Jobs finish work on a preassembled computer circuit board. It has no Product keyboard, case, sound or graphics. They call it the Apple I. They form the Apple Computer Company on April Fool's Day and sold the Apple I board for $666.66 at the Home brew Computer Club in Palo Alto, California. In 1977 the Apple II is available to the general public. Fully assembled and pretested, it includes 4K of standard memory, and comes equipped with two game paddles and a demo cassette. The price is $1,298. Customers use their own TV set as a monitor and store programs on audio cassette recorders. Compare this price with computers today. The price about the same, but the computer has changed tremendously. In 1979 Apple II+ is introduced, available with 48K of memory and a new auto-start ROM for easier startup and screen editing for $1,195. Apple II Pascal is also released. In 1980 Apple FORTRAN introduced and proves to be a catalyst for high-level technical and educational applications. Apple III announced at the National Computer Conference. It has a new operating system, a built-in disk controller and four peripheral slots priced at $3,495, the Apple III is the most advanced system in the company's history. Product In 1981 Accessory Products Division formed to handle production of printers, modems and other peripherals. The Apple Language Card is introduced.

International Issues Essay

Abstract No two countries have the same political and legal system. Each country has its own laws and regulations on business and products. When doing business in another country it is important to know the laws and abide by them. Culture plays a huge part in a business’s success when venturing into a foreign market. Being sensitive to the cultural and religious beliefs in that country is important to a business’s long term success. A business needs to be educated in the laws, customs and cultures of that country so that business will be able to comply and coincide with that country. A business needs to know how and where to resolve any legal issues that may arise while doing business in that country. Disputes need to be handled in a way that is respectful to that country and adheres to the contract in which the parties agreed. International Issues Issues in Legal Disputes in International Transactions â€Å"International transactions and dispute resolution requires both an understanding of the law and a sensitivity to foreign culture, politics, formal and informal power structures and decision-making approaches† (White and Williams LLP, 2013). When entering into a contract with a foreign country, one needs to be very specific in the contract about how to resolve any issues that could come up between the two companies. Deciding and agreeing on where issues will be resolved is a key element in the contract. Going to court can be costly for both companies and the decision made by the court could take an extended amount of time. If the companies were to go to court, deciding in where the court hearing would take place is another issue. If the hearing was to be held in the foreign country, the laws might not be the same and that country might not have much experience in international disputes. If the hearing was to be held in the United States, the other company and the country’s government it resides in could become hostile and not uphold the ruling. Arbitration would be the best way to resolve any disputes between the two countries. Arbitration can save a lot of time and money for both companies while also protecting the images of both companies by not having a lengthy trial in the press. â€Å"Arbitration is often less costly, less litigious, and less time-consuming, and offers more privacy to the parties than litigation† (Companies Export, 2008).The ruling from the arbitration could be binding or non-binding depending on what is agreed upon in the contract. Practical Considerations When trying to resolve a dispute with a company in a foreign country, one would need to look over the written contract that was drawn up at the beginning of the relationship. â€Å"The governing law clause will set out which country’s law will apply to any dispute under the contract, and the jurisdiction clause will state in which country the legal action must be taken† (Smith, 2007). The U.S. based company needs to be aware of the laws that affect the company and the business dealings in the other country. The company needs to consider the cultural aspects, the ethical behavior, and the legal structure within that country. â€Å"U.S. laws governing the international business activities of the U.S. companies fall into two categories. The first consists of laws, such as antitrust, employment, and economic-espionage laws, that are also applied frequently in the domestic context. With respect to these laws, the international business activities of the U.S. companies are a rguably at special risk because management educated and trained outside the United States might be less familiar with these laws than management educated and trained in the United States† (Winer, 2013). Bribery is also a consideration when taking legal action against a foreign business partner because this is illegal under the U.S. Foreign Corrupt Practices Act (FCPA). In some countries, bribery and gift giving is not seen as an illegal or unethical act but a form of showing respect and gratitude. A company needs to be careful on how this is perceived because it could be seen as an illegal act on the company’s part. Factors against CadMex Time and money would work against CadMex in the sublicensing agreements. In the simunlation, Candore is under an epidemic and needs the medicine ViroBlax at a subsidized price. There would not be enough time, due to the epidemic, to work out a contract that both parties will agree upon. Each separate pharmaceutical company in Candore would have to be sought out and a new contract would have to be drawn up for each different company. This is not only costing CadMex time but countless dollars on man hours. CadMex would have to invest a lot of money into properly training the employees and building the proper facilities. CadMex would also have to insure that the generic products were to the proper standards and up to regulation. Even if CadMex was to invest the time and the money into sublicensing the drug, CadMex would lose money because the drug is being sold at a subsidized price. The royalties that would be paid out with sublicensing still would not gap the margin of loss that CadMe x has. When Customs and Laws Conflict When the local customs and the local laws conflict with the customs and laws of an organization operating abroad; the organization should look at the customs and laws in which it is operating under and those should prevail, as long as the company is following the laws in which it is to operate by. When operating abroad, it is important to be aware and sensitive to the customs of that country. Allowing employees to observe religious and cultural holidays will not only keep moral high but also will keep the company within the laws that country has. Knowing the cultural normalities and integrating those into the business model will allow for the employees and members of the community to feel that the business has their interests mind. Being able to comply with the laws of the country in which the business is in while also complying with the laws set by the country, in which the mother company resides, can be a hard line to walk. Complying with the laws of the country in which was agreed upon in the contract at the onset of the partnership would prevail. Making sure to follow the rules of the country that the business is in is important because that is where the business will produce its goods. â€Å"Employees who engage in international business are responsible for knowing and complying with both the laws and regulations of the countries in which the businesses operate and the U.S. law and regulations that apply outside U.S. borders. If U.S. law conflicts with the local customs, or if the local law is more restrictive than U.S. laws or company policies, one must follow the more restrictive law, custom or policy† (Olin, 2012). Resolving Domestic and International Issues Resolving domestic issues can be done through arbitration or through the court system. It can be as simple as suing a party and showing up to court. When trying to resolve an issue domestically, the laws are well known for both parties and the venue in which the issue will be settled is easily accessible to both parties. Resolving an issue internationally is more work involved. The issue has to be resolved through which venue both parties agreed upon when signing the contract. Both companies need to know the laws of that country and travel might be needed. If arbitration was selected, both parties would need to submit all paperwork to a panel of arbitrators and adhere to the judgment in which the panel decides. If one party does not comply with the ruling, then legal action must be taken. Conclusion When doing business internationally, a company needs to be aware of many factors. Conforming to the culture and abiding by the laws that are set in that country are essential to that business and its success. A company needs to know how to resolve issues that will come up in the daily running of the business. Being sensitive to religious and cultural norms will not only help with the moral of employees but the community as well. Adhering to the contract in which the company agreed upon will help avoid any legal action being taken against them. By following the laws and cultures of the country the business resides in will ensure success of the company and future dealings in that country. References Companies Export. (6/4/2008).
